
{"id":3330,"date":"2018-02-12T14:18:01","date_gmt":"2018-02-12T14:18:01","guid":{"rendered":"https:\/\/www.valuationtribunal.ie\/?page_id=3330"},"modified":"2020-02-18T11:06:31","modified_gmt":"2020-02-18T11:06:31","slug":"summary-evidence-derelict-sites","status":"publish","type":"page","link":"https:\/\/www.valuationtribunal.ie\/ga\/preparing-for-hearing\/summary-evidence-derelict-sites\/","title":{"rendered":"Summary of Evidence &#8211; Derelict &#038; Vacant Sites"},"content":{"rendered":"<h4><strong>Summaries of Evidence\u00a0for\u00a0<u>Derelict &amp; Vacant Site<\/u>\u00a0appeals<\/strong><\/h4>\n<p>&nbsp;<\/p>\n<ol>\n<li>Both parties to an appeal are required to give evidence at the hearing.<\/li>\n<\/ol>\n<p>The parties to an appeal are:<\/p>\n<p><strong>The Appellant<\/strong>\u00a0(i.e. the person\/company\/organisation making the Appeal)<\/p>\n<p><strong>The Respondent<\/strong>\u00a0(i.e. the Rating Authority that has made the determination of Market Value which is being appealed)<\/p>\n<ol start=\"2\">\n<li>In advance of the hearing,\u00a0the Tribunal requires written summaries of evidence\u00a0from each party. These should contain the material on which you intend to rely at the hearing. NB summaries of evidence cannot be submitted by fax or email.<\/li>\n<\/ol>\n<ol start=\"3\">\n<li>Your written summaries of evidence should also include\u00a0photographs and maps\u00a0of:<\/li>\n<\/ol>\n<p>the property that is the subject of the appeal<\/p>\n<p><em>and<\/em><\/p>\n<p>properties that are cited as comparisons in the evidence<\/p>\n<ol start=\"4\">\n<li>You must submit <strong>Five<\/strong> summaries of evidence\u00a0by the date &amp; time stated\u00a0in the attached letter, as follows:<\/li>\n<\/ol>\n<p><strong>Four<\/strong> summaries of evidence must be sent or delivered to:<\/p>\n<p>The Registrar<br \/>\nThe Valuation Tribunal<br \/>\n3rd Floor, Holbrook House<br \/>\nHolles Street<br \/>\nDublin 2<\/p>\n<p><strong>One<\/strong> summary of evidence must be exchanged* with the derelict sites section of the Rating Authority that has made the determination of Market Value which is being appealed.<\/p>\n<p><em>*The purpose of the exchange of summaries of evidence between parties is to provide an opportunity to raise and address any factual disagreements in advance of the Tribunal hearing.<\/em><\/p>\n<ol start=\"5\">\n<li>For further information, please refer to the <a href=\"https:\/\/www.valuationtribunal.ie\/wp-content\/uploads\/2020\/01\/Valuation-Tribunal-Rules-2019.pdf\">Valuation Tribunal Rules 2019<\/a><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Summaries of Evidence\u00a0for\u00a0Derelict &amp; Vacant Site\u00a0appeals &nbsp; Both parties to an appeal are required to give evidence at the hearing.
